Game Concept: The Roush Fenway Racing You Pick ‘Em Challenge is a game of skill, and winners will be determined by the objective criteria set forth herein. From all eligible entries received, winners will be determined by the participant who uses his or her knowledge of the historical events surrounding NASCAR Sprint Cup, Nationwide and Craftsman Truck Series racing, including relative strengths and weaknesses, to accumulate the most points during the game terms as defined below. Games may not be used in any form of gambling. This game has no affiliation with the National Association of Stock Car Auto Racing (NASCAR) and does not present itself as being licensed, sanctioned, or in any way affiliated by that body.

How to Play: Every week, players will predict the official finish position for every Roush Fenway entry in every NASCAR Sprint Cup, Nationwide and Craftsman Truck Series race. Players earn points according to how accurately they predict the official finishing position of the Roush cars and/or trucks each race week.

Scoring

An exact pick of an entry finish will receive 100 points PLUS the point amount of the finish based on the NASCAR Sprint Cup, Nationwide and Craftsman Truck Series points system including bonus points for leading a lap, and leading the most laps.

For example, if a player chooses the No. 6 Cup car to finish 5th and it finishes 5th, that player will receive 100 points plus a bonus 155 points for a total of 255 points for that pick.

Players will receive points for guessing a finishing position within a certain range. The points would be awarded as follows:

· A pick within (+/-) 5 finishing positions will receive 80 points

· A pick within (+/-) 6-10 finishing positions will receive 60 points

· A pick within (+/-) 11-15 finishing positions will receive 40 points

· A pick within (+/-) 16-20 finishing positions will receive 20 points

· A pick within (+/-) 21 or more finishing positions will receive 0 points

For example, if a player guesses that the No. 17 car will finish 10th in a cup race and it finishes 15th, then that player will receive a total of 80 points for that pick. If a player guesses that the No. 6 truck will finish first in a truck race and it finishes 19th, that player will receive a total of 20 pts. And if a player guesses that the No. 60 car will finish second in a Nationwide race, and it finishes second (and leads a lap), that player will receive 275 points (170 + 5 race points + 100 bonus points).

Every race week, each player’s Roush Fenway Racing You Pick ‘Em Challenge score will be calculated by combining the total number of points they earn from each of their predicted finishing positions for that week's race.

How to Win

The Roush Fenway Racing You Pick ‘Em Challenge features eight divisions, or ‘games within the game;’ one for each of the 2008 Roush Fenway drivers (Greg Biffle, Erik Darnell, Carl Edwards, Matt Kenseth, Jamie McMurray, David Ragan, Colin Braun, Joey Clanton). All players will select which driver’s game they want to play in, to win weekly and championship prizes.

Every week, each player’s Roush Fenway Racing You Pick ‘Em Challenge score is calculated by combining the total number of points from all of the predicted Roush Fenway Sprint Cup, Nationwide and Craftsman Truck Series entry finishing positions for that one race weekend.

The one player who scores the most points among all players in all divisions receives a Roush Fenway Racing t-shirt and hat.

How to Win the Championship

By scoring a top-10 result PER DRIVER DIVISION during any weekend or round during the first 30 race weekends of the 2008 season, or by finishing in the top-10 PER DRIVER DIVISION after the first 30 race weekends of the 2008 season, players become eligible to compete in the ‘Chase Challenge" during the last 10 races of the 2008 season. All players who ‘make the chase’ will then compete during the final 10 race weekends for the Roush Fenway Racing You Pick ‘Em Challenge grand prizes, based on their cumulative scores from the last 10 races only.

Season-ending championship prizes will be awarded to the three (3) entrants that accumulate the most points throughout the Roush Fenway Racing You Pick ‘Em Challenge. The championship prizes are as follows:

WINNER’S CHOICE OF ONE (1): Honorary Pit Crew Member [Two (2) nontransferable pit passes* to the 2009 Sprint Cup race of the winner’s choice; RACE TICKETS ARE NOT INCLUDED. Valid for day of Sprint Cup race only; Roush Fenway Racing will not be responsible for travel arrangements, including car, air travel or hotel but will provide track chaperone for garage tour; details to be arranged with the winner]

OR

Fan in the Stands [Two (2) grandstand tickets* to the 2009 Sprint Cup race of the winner’s choice]

The winner will also receive a set of 2008 Roush Fenway Racing signed 1:24 scale die-cast cars (Cup drivers only; Five (5) cars total)

*Because of circumstances beyond Roush Fenway Racing’s control, tickets and passes are not available for Bristol, Chicago, Kansas, Martinsville, New Hampshire and Richmond.

SECOND PLACE: Set of 2008 Roush Fenway Racing signed 1:24 scale die-cast cars (Cup drivers only; Five (5) cars total

THIRD PLACE: Roush Fenway Racing Let’s Go Racing Prize Package (selection of merchandise valued at $350)

How Else to Win

The Roush Fenway Racing You Pick ‘Em Challenge features eight (8) divisions, or ‘games within the game,’ one for each of the eight (8) 2008 Roush Fenway drivers. All players will select which driver’s game they want to play in, and at the end of the season, each of the eight (8) driver division champions will receive a Roush Fenway Racing signed 1:24 scale die-cast car from their driver.

Roush Fenway reserves the right to substitute any and all prizes listed above for something else of equal value, if necessary. In case of a tie, a tiebreaker will determine one winner; if a tie still exists, one winner will be chosen by random drawing. Winner will be notified by email.

Chances of winning weekly and championship prizes depend upon the total number of entries received and the skill used in choosing your drivers. Prizes are not transferable and must be accepted as awarded, no cash equivalents, no substitutes, except as determined by Roush Fenway in its sole discretion. Winners must be domiciled residents of the United States. All winners automatically grant to Roush Fenway the right to use their name, address and photo for publicity without compensation. Taxes are the sole responsibility of the winners.

Prize winners will receive a tax Form 1099-M and will be required to sign an affidavit of eligibility and a liability release within ten days of notification. In the event of non-compliance, the prize will not be awarded. Organizers and sponsors are not responsible for any damages or injury incurred by a Roush Fenway Racing You Pick ‘Em Challenge entrant as a result of winning. For a list of all winners, send a #10, SASE to Roush Fenway, 4600 Roush Place, Concord, NC 28027 no later than June 2009.

Eligibility: Roush Fenway Racing You Pick ‘Em Challenge participants must be 18 years of age or older as of February 15, 2008; all federal, state, and local laws and regulations apply, void wherever prohibited or restricted by law. All employees and immediate family members of Roush Fenway, its sponsors, advertising, production, and fulfillment agencies are not eligible for prizes.

Weekly Entry Deadlines: Players can change their picks at anytime during the week prior to Noon on the day of each NASCAR Sprint Cup, Nationwide, and Craftsman Truck Series race. At 9:00 A.M. MST (Arizona) on the day of each race, the site changes to show the player’s confirmed car or truck finish position picks for that series race(s) and allow players to select drivers for the next week’s race(s).

The Commissioner’s Office: An official standards and practices committee called The Commissioner’s Office has been established to govern the rules and play of the Roush Fenway Racing You Pick ‘Em Challenge. You may address any questions, discrepancies, concerns or suggestions to The Commissioner’s Office, c/o Roush Fenway Racing You Pick ‘Em Challenge, P.O. Box 12523, Tempe, Arizona 85284. The Commissioner’s Office reserves the right to adjust any rule if such an adjustment best serves all competitors. The Commissioner’s Office also reserves the right to disqualify or refuse service to anyone if there is any evidence of tampering or manipulation.

Errors: In the event that you believe The Commissioner’s Office has made an error, it is the sole responsibility of you, the Roush Fenway Racing You Pick ‘Em Challenge participant, to inform The Commissioner’s Office within seven days of the end of the Roush Fenway Racing You Pick ‘Em Challenge Race Week in which you believe the error occurred. All efforts will be made to correct the error; however the decision of The Commissioner’s Office is final.

Publicity: Roush Fenway Racing reserves the right to use Roush Fenway Racing You Pick ‘Em Challenge entrant’s names for publicity. Winners automatically grant to Roush Fenway the right to use their name and likeness in advertising and promotion of this event without further permission or compensation unless prohibited by law.

Mailing List: Roush Fenway does not sell or rent the registration information that you provide and will abide by the privacy policies set forth on the Roush Fenway web sites. Notwithstanding the foregoing, Roush Fenway may disclose your personal information when required by law or in order to comply with any governmental agency. Roush Fenway does not guarantee the safety of the information sent by participants, and all information is sent at the participant’s own risk. By participating in the Roush Fenway Racing You Pick ‘Em Challenge, you hereby agree to all personal information uses and disclaimers explained above.

Schedule Changes: Roush Fenway takes no responsibility for any races that are delayed or postponed (i.e., strikes, weather, riots). For any reason and without notice, Roush Fenway reserves the right to cancel the Roush Fenway Racing You Pick ‘Em Challenge without compensation.

Gambling: The Roush Fenway Racing You Pick ‘Em Challenge may not be used for any form of gambling. Void where prohibited by law.

General: By entering the Roush Fenway Racing You Pick ‘Em Challenge you (1) acknowledge acceptance of these rules and agree to adhere to and be bound by them, and (2) release, and waive any rights of recovery against or in connection with Roush Fenway and their respective sponsors, contractors, agents, officers, and employees from and against any claims, expenses, damages and/or liability incurred by you in connection with or related to the operation of, or your participation in the Roush Fenway Racing You Pick ‘Em Challenge, and (3) agree to hold Roush Fenway harmless from all typographical, statistical, transaction, and communication errors or omissions, and Roush Fenway reserves the right to disqualify any participant for suspected cheating or non-adherence to these

Official Rules

Additional Legal Disclaimers:  The Roush Fenway Racing You Pick ‘Em Challenge is open to legal residents of the 50 United States and Washington DC and Canada (excluding Puerto Rico and Quebec) 18 years of age or older (if the age of a majority in a jurisdiction is different than 18, you must be of the age of majority within your jurisdiction to be eligible to receive a prize) with a valid internet e-mail address as of February 15, 2008. Void where prohibited. Excluded residents may play, but WILL NOT be eligible to receive any prizes. By entering, each entrant accepts and agrees to be bound by these rules and by the decision of the judges which shall be final and binding in all respects. Taxes, if any, are the sole responsibility of the prize winners. No substitution or transfer of prizes permitted except by Roush Fenway, and Roush Fenway reserves the right to substitute a prize for one of equal or greater value in the event that an advertised prize is unavailable. All prize winners may be required to submit valid identification to Roush Fenway and to execute an affidavit of eligibility and a liability/publicity release within 10 days following attempted notification. Failure to comply within this time period may result in disqualification and awarding of the prize to the entrant with the next highest score.

All federal, state and local laws and regulations apply. Roush Fenway is not responsible for lost, late or misdirected online entries, for incorrect, inaccurate or incomplete entry information whether caused by a contestant, equipment, or technical malfunction or for any human error, technical error or malfunctions. Roush Fenway reserves the right to halt the Game at any time during the contest period for any reason. In the event that a scheduled race is canceled or preempted for any reason, no points will be awarded for that week for drivers on the affected teams.

Roush Fenway is not responsible for typographical or other human or technical errors in the offer or administration of this Game, including but not limited to errors in advertising, the Official Rules, the selection and announcement of the winner or the distribution of the prizes.

Roush Fenway reserves the right to modify these rules for clarification purposes without materially affecting the terms and conditions of the Game. If for any reason the Internet portion of the program is not capable of running as planned, including infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of Roush Fenway which corrupt or affect the administration, security, fairness, integrity, or proper conduct of this Game, Roush Fenway reserves the right at its sole discretion, to disqualify any individual who tampers with the entry process, and to cancel, terminate, modify or suspend the Game. In such event, Roush Fenway further reserves the right to award the Grand Prize to the player with the most points, as of the termination date.

Roush Fenway assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, entries. Roush Fenway is not responsible for any problems or technical malfunction of any telephone network or lines, computer on line systems, servers, or providers, computer equipment, software, failure of any e-mail or entry to be received on account of technical problems or traffic congestion on the Internet or at any Web site, or any combination thereof, including any injury or damage to participant’s or any other person’s computer related to or resulting from participation or downloading any materials in this Game.

CAUTION: ANY ATTEMPT BY A CONTESTANT TO DELIBERATELY DAMAGE ANY WEB SITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE GAME IS IN VIOLATIONS OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, ROUSH FENWAY RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH CONTESTANT TO THE FULLEST EXTENT PERMITTED BY LAW.

In the event of a dispute, entries made by Internet will be declared made by the authorized account holder of the e-mail address submitted at time of entry. "Authorized account holder" is defined as the natural person who is assigned to an e-mail address by an Internet access provider, on line service provider or other organization (e.g., business, educational, institution, etc.) that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address.

Roush Fenway reserves the right to halt, modify, or suspend the Game at any time due to situations beyond the control of sponsors such as strikes, acts of God, etc.

In the event that the Game is challenged by any legal or regulatory authority, Roush Fenway reserves the right to discontinue or modify the Game, or to disqualify participants residing in the affected geographic areas. In such event, Roush Fenway shall have no liability to any players who are disqualified due to such an action.
